Title deeds in Cyprus: what protects you, and when
On a new apartment in Cyprus you usually become the legal owner in two stages: your contract is deposited at the Land Registry straight after signing, and the title deed is issued in your name once the building is finished and divided into units. Here is how each stage works, what can delay it, and the checks that protect you.

The short answer
- A title deed is the Land Registry's certificate that a property is registered in your name.
- Deposit your sale contract at the Land Registry within 6 months of signing. It costs €50 and stops the seller selling or charging the home to anyone else.
- On a new apartment, the deed follows completion: the building needs its Certificate of Final Approval, then separate titles for each unit.
- On a resale with a deed, ownership is transferred at the Land Registry directly.
What a title deed is
The Department of Lands and Surveys (DLS), the Land Registry, records who owns every plot and building in Cyprus. A title deed is its certificate of registration for one property. On a plot with a house the deed covers the land; in a block of apartments each flat gets its own deed only after the building has been divided into units on the register.
For that division the developer first needs the Certificate of Final Approval from the building authority, confirming the building matches its permits. The DLS then surveys the building and issues a separate title for each unit.
Depositing the sale contract
Until your deed is issued, your protection is the Sale of Land (Specific Performance) Law 81(I)/2011. It works once the sale contract is deposited at the DLS district office:
- Deadline: within 6 months of signing. After that you need a court order, and transfer fees later rise by 10%.
- Cost: €50. Contracts signed from 1 January 2026 no longer need stamping first, since stamp duty was abolished.
- Effect: the DLS will not accept a later contract for the same unit, the property cannot be sold or charged without your consent, and you can go to court to force the transfer to you.
- If the developer's land carries a mortgage, you can pay the instalments for your unit straight to the lending bank so the bank releases it.
- You can assign the contract to a buyer of your own without the seller's consent.
Deposit does not make you the registered owner and does not release a developer's mortgage by itself. For contracts signed from 12 December 2023, Law 132(I)/2023 also requires the seller to attach a recent DLS search certificate, sets out how a mortgaged unit is released, and allows the DLS to fine sellers and banks that breach it.
Why title deeds take time
- The building differs from its permits, so the Certificate of Final Approval is held up until it is put right.
- The developer's mortgage on the plot has not been released for your unit.
- Processing at the DLS and the building authority, after the developer applies.
Past failures left many buyers waiting years: the "trapped buyers". The 2015 law that let them get deeds without the developer was largely struck down by the Supreme Court in June 2024. Its replacement, Law 110(I)/2025 of July 2025, covers contracts deposited by the end of 2014 and gives the bank a route to consent, or the buyer a route through the courts. In June 2026 the Interior Minister reported about 9,500 applications under the old law, and some 15,000 further buyers held up by planning breaches.
There is no official typical waiting time for a building finished today. Ask the developer directly: has the planning permit been followed, is there a mortgage on the plot, and when will they apply for the Certificate of Final Approval.
Buying new vs resale
| New from a developer | Resale with a title deed | Resale without a title deed | |
|---|---|---|---|
| How you buy | Sale contract, deposited at the DLS | Transfer at the DLS | Assignment of the seller's contract, deposited at the DLS |
| When you are registered owner | After the building's separate titles are issued | On the day of transfer | When the developer's titles are issued |
| Tax on the sale | VAT (5% or 19%) | Transfer fees, halved | Transfer fees, halved, on later transfer |
| Main check | Permits, plot mortgage, payment schedule | Search certificate, debts on the property | Original contract, its deposit, the developer's position |
Transfer fees are 3% up to €85,000, 5% to €170,000 and 8% above, halved, and not charged when VAT was paid: see the cost of buying property in Cyprus.
Checks your lawyer should make
- A DLS search certificate on the plot or unit: owner, mortgages, charges, other deposited contracts.
- The planning and building permits, and whether the building follows them.
- Whether a Certificate of Final Approval has been issued, or when it will be applied for.
- On a mortgaged plot, the bank's release undertaking for your unit (Law 132(I)/2023 sets the forms).
- On a resale, clearance of the seller's local authority, sewerage and water dues, and the tax clearance the DLS needs for transfer.
- If you are from outside the EU, the permit to acquire property from the district office. Until it is granted the contract gives you no ownership right.
In September 2026 the government sent Parliament bills to restrict purchases by non-EU buyers, including limits on size and location and a minimum holding period. They are proposals and not retroactive; ask your lawyer where they stand when you buy.
